Terms of Service

By accessing or using the Service in any capacity — including but not limited to viewing profiles, subscribing, purchasing the Core Package, Add-On Video, Freshen Up service, or submitting personal content for inclusion on the Service — you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms in full, you must not use the Service or submit any content to it.

Inkinthepenn.com is the nation's first video gram bio platform connecting incarcerated individuals with the outside world. The Service displays short video gram bios, biographical information, likes, hobbies, music preferences, and personal messages of incarcerated applicants who have voluntarily applied and paid for inclusion.

The Service does not facilitate direct messaging between site visitors and inmates. All initial contact must be made independently through GTL Getting Out or other prison-approved communication systems. Inkinthepenn.com is not responsible for any communication, relationship, or outcome that may result from contact made through such third-party platforms.

Critical — Read Carefully

By submitting a video gram, photograph, biographical information, written content, or any other materials ("Submitted Content") to Inkinthepenn.com, and/or by purchasing the Core Package, Add-On Video, Freshen Up service, or any other paid product, the Applicant irrevocably grants Inkinthepenn.com, its founder Kenneth Massie, its successors, assigns, licensees, and partners the full and exclusive worldwide right, license, and authority to:

• Use, reproduce, display, distribute, perform, broadcast, transmit, and publicly exhibit the Applicant's name, image, likeness, voice, video, photograph, biographical content, and any other Submitted Content in any and all media now known or hereafter devised, including but not limited to the Service, social media, advertising, marketing, promotional materials, third-party platforms, and editorial features.
• Edit, crop, modify, enhance, caption, watermark, combine with other content, or otherwise alter the Submitted Content as Inkinthepenn.com sees fit, without further notice or consent.
• Create and distribute derivative works based on the Submitted Content.
• Use the Submitted Content for commercial, editorial, advertising, promotional, fundraising, and any other lawful purpose, in perpetuity.
• Sub-license any of the above rights to third parties (including media outlets, syndication partners, and advertising platforms) without further consent or compensation.

The Applicant acknowledges and agrees that this grant of rights is perpetual, irrevocable, royalty-free, and worldwide. No additional compensation beyond the original purchase price of the selected package shall be owed to the Applicant for any use, reuse, or sub-license of the Submitted Content. The Applicant waives any right to inspect or approve any final use of the Submitted Content.

The Applicant represents and warrants that they are the sole owner of, or have obtained all necessary rights to grant the licenses set forth in this Section regarding, the Submitted Content, and that the Submitted Content does not infringe any third-party rights.

Current pricing is published at inkinthepenn.com/pricing. All purchases are final and non-refundable except as expressly provided in our Refund Policy. All applicable taxes (currently 6.5%) will be added at checkout.

Inkinthepenn.com reserves the right to modify pricing at any time without prior notice. Existing active listings will not be affected mid-cycle by pricing changes.

Submitted Content must comply with all applicable laws and the rules of the Applicant's correctional institution. Submitted Content may not contain: profanity, threats, sexually explicit material, gang signs or affiliations, references to ongoing criminal activity, contact information for direct circumvention of institutional communication systems, or any material that violates the policies of the relevant Department of Corrections.

Inkinthepenn.com reserves sole and absolute discretion to reject, remove, modify, or refuse to publish any Submitted Content for any reason. No refund will be issued for content removed for violation of these standards.

Visitors agree to use the Service lawfully and respectfully. Harassment, threats, scraping of profile data, or attempts to circumvent the paywall are strictly prohibited and may result in account termination.

Free visitors receive five (5) profile views before subscribing to the $1.00/month subscription is required for continued access.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. Inkinthepenn.com makes no representations regarding the accuracy of profile information submitted by Applicants, nor does it endorse any relationship that may form between visitors and Applicants.

Inkinthepenn.com is not a correspondence facilitator and assumes no responsibility for the content, safety, or outcome of any communication initiated through GTL Getting Out or any other third-party platform.

To the maximum extent permitted by law, Inkinthepenn.com, Kenneth Massie, and their affiliates, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

Aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount paid by the claimant to Inkinthepenn.com in the twelve (12) months preceding the claim.

All Inkinthepenn.com branding, including the "Inkinthepenn" wordmark, the "IN THE PENN" logo, all related graphic elements, the tagline "Not greedy, undercut is the name of the game," and the platform design are the sole property of Kenneth Massie and Inkinthepenn.com. Unauthorized reproduction or use is prohibited.

We may modify these Terms from time to time. Changes become effective when posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance.

These Terms are governed by the laws of the State of Ohio, United States. Any disputes shall be resolved in the state or federal courts located in Ohio.
